Resignation of Professional Staff Members Release from Contract
Resignations shall be presented in writing to the superintendent. A non-tenured teacher desiring to terminate employment shall submit a letter to the superintendent giving reasons for the termination not later than April 30. In the case of a tenured teacher they shall notify the superintendent in writing no later than June 1. Once under contract, only the Board has the authority to release an employee from a contract. Once a non-tenured employee has signed and returned their contract, the employee will fulfill the responsibilities of their contract.
The Board reserves the right to pursue all available legal remedies when an employee breaks a contract with the district including, but not limited to, filing charges to have a teaching certificate or professional license revoked or seeking a monetary judgment.
Should a non-tenured employee wish to be released from their contract after April 30, the release will be granted upon the payment of liquidated damages and a suitable replacement is found. If a tenured teacher wishes to be released, damages would not accrue until after June 1. However, an employee will not be released from a contract unless a suitable replacement is found.
The following schedule of damages has been established by the Board of Education and reflects the approximate additional cost that will be incurred by the district in replacing the employee.
Date Resignation Submitted | Amount of Damages Assessed |
Before May 1 | no penalty |
May 1-June 1 (non-tenured only) | $1,500 |
June 2- June 30 (tenured and non-tenured) | $2,000 |
July 1 or later (tenured and non-tenured) | $3,000 |
The board reserves the right to grant release without penalty upon review of the circumstances.
