R 2610 Misconduct and Disciplinary Consequences

The discipline code set out in this regulation is intended to be illustrative but not an exclusive listing of acts of misconduct and the consequences for each. Misconduct, which is not specifically listed in this regulation, may be deemed to warrant discipline up to and including expulsion following provision of all due process procedures. In addition, the disciplinary consequences listed for each offense may be increased or decreased by the Administration of the Board of Education due to mitigating or aggravating circumstances.

Copies of this regulations or the student handbook which includes the code of student conduct and disciplinary consequences, as well as the District’s corporal punishment policy, if any, will be provided to each student at the beginning of each school year.  Copies of these documents will also be available for public inspection during normal business hours in the Superintendent’s office.

The following are descriptions of prohibited conduct as well as potential consequences for violations. Building-level administrators are authorized to more narrowly tailor potential consequences as appropriate for the age level of students in the building. All consequences must be within the ranges established in this regulation. In addition to the consequences specified here, school officials will notify law enforcement and document violations in the student's discipline file pursuant to law and Board policy.

Academic Dishonesty – (Regulation 2610) – Academic Dishonesty includes but is not limited to: Plagiarism, cheating by copying another student's homework, quiz, or test by any method (including electronic devices, computers, and internet), or enabling someone else to cheat (giving your assignment to someone else, giving answers to tests, etc).

Plagiarism:

First Offense:  Principal/Student conference and/or Zero on assignment or test, parent contact.

Subsequent Offenses:  Disciplinary referral, zero on assignment or test and In-School-Suspension, parent contact, and documentation in student’s discipline record.

Alcohol - (Regulation 2610) – Possession of or presence under the influence of alcohol on school property (ex: at school, school bus, parking lot, playground, etc.), or at a school activity whether on or off of school property.

First Offense:  Principal/Student Conference, Parent Contact, In-School Suspension, 1-180 days Out-of-School Suspension, and/or notification to law enforcement officials, and documentation in student’s discipline record.

Subsequent Offenses:  In-School Suspension, Out-of-School Suspension, Expulsion, and/or notification to law enforcement officials, and documentation in student’s discipline record.

Arson - (Regulation 2610) – Intentionally causing or attempting to cause a fire or explosion.

First Offense:  11-180 days Out-of-School Suspension, notification to law enforcement officials, and documentation in student’s discipline record.

Subsequent Offenses:  Expulsion, notification to law enforcement officials, and documentation in student’s discipline record.

Assault - (Refer to Policy and Regulation 2673- Reporting of Violent Behavior) – Use of physical force with the intent to do bodily harm.

  1. ASSAULT OF STAFF MEMBER – Attempting to cause injury to a staff member; intentionally placing a staff member in reasonable apprehension of imminent physically injury.

First Offense:  1-180 days Out-of-School Suspension or Expulsion, notification to law enforcement officials, and documentation in student’s discipline record.

Subsequent Offenses:  1-180 days Out-of-School Suspension or Expulsion, notification to law enforcement officials, and documentation in student’s discipline record.

  1. ASSAULT OF STUDENT – Attempting to cause injury to a student; intentionally placing a student      in reasonable apprehension of imminent physically injury.

First Offense:  In-School Suspension, 1-180 days Out-of-School Suspension or Expulsion, possible notification to law enforcement officials, and documentation in student’s discipline record.

Subsequent Offenses:  1-180 days Out-of-School Suspension or Expulsion, notification to law enforcement officials, and documentation in student’s discipline record.

Bullying - Intentional intimidation or infliction of physical, emotional, or mental harm (see Policy 2655)

First Offense:  Loss of Privileges, Classroom Detention, Conference with Teacher, Parents Contacted, Conference with Principal, In-School Suspension, Out-of-School Suspension, Expulsion and Law Enforcement Contacted

Subsequent Offenses:  Loss of Privileges, Classroom Detention, Conference with Teacher, Parents Contacted, Conference with Principal, In-School Suspension, Out-of-School Suspension, Expulsion and Law Enforcement Contacted

Bus Misconduct

First Offense:  Principal/Student Conference, In-School Suspension, 1-180 days Out-of-School Suspension, or 1-3 days Bus-Suspension

Second Offense:  Principal/Student Conference, 1-5 days Bus-Suspension, In-School Suspension, or Out-of-School Suspension

Third Offense:  Principal/Student Conference, 1-180 days Bus-Suspension, In-School Suspension, or Out-of-School Suspension

 Subsequent Offenses: Could result in permanent removal from riding the bus or Out-of-School Suspension.

Fighting - Physically striking another in a mutual contact as differentiated from an assault

First Offense:   Principal/Student Conference, In-School Suspension, or 1-180 days Out-of-School Suspension

Subsequent Offenses:  In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Defiance of Authority - Refusal to obey directions or defiance of staff authority

First Offense:  Principal/Student Conference, In-School-Suspension, or 1-180 days of Out-of-School Suspension

Subsequent Offenses: Principal/Student Conference, In-School-Suspension, 1-180 days of Out-of-School Suspension, or Expulsion

Disruptive Behavior - Conduct which has the intentional effect of disturbing education or the safe transportation of a student

First Offense:  Principal/Student Conference, In-School-Suspension, or 1-180 days of Out-of-School Suspension

Subsequent Offenses:  Principal/Student Conference, In-School-Suspension, 1-180 days of Out-of-School Suspension, or Expulsion

Drugs/Controlled Substance

Possession or presence under the influence of a controlled substance or substance represented to be a controlled substance on school property (ex: at school, school bus, parking lot, playground, etc.), or at a school activity whether on or off of school property.

First Offense:  11-180 days Out-of-School Suspension or Expulsion

Subsequent Offenses:  11-180 days Out-of-School Suspension or Expulsion

Sale or distribution of a controlled substance or substance represented to be a controlled substance while at school or at any of the locations described above

First Offense:  11-180 days Out-of-School Suspension or Expulsion

Subsequent Offenses:  Expulsion

Prescription Medication

Possession of a prescription medication without a valid prescription for such medication on school premises or on a school bus

First Offense:  11-180 days Out-of-School Suspension or Expulsion

Subsequent Offenses:  11-180 days Out-of-School Suspension or Expulsion

Distribution of prescription medication to any individual who does not have a valid prescription for such medication on school premises or on a school bus

First Offense:  11-180 days Out-of-School Suspension or Expulsion

Subsequent Offenses:  Expulsion

Extortion - Verbal threats or physical conduct designed to obtain money or other valuables

First Offense:  Principal/Student conference, In-School Suspension, or 1-10 days Out-of School Suspension

Subsequent Offenses:  In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

False Alarm – Tampering with emergency equipment, setting off alarms, making false reports

First Offense: Principal/Student Conference, In-School Suspension, 1-180 days Out-of School Suspension, or Expulsion

Subsequent Offenses:  Principal/Student Conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Firearms and Weapons (Refer to Policy and Regulation 2620 - Firearms and Weapons in School)

Possession of a firearm or weapon

First Offense:  One calendar year suspension or Expulsion

Harassment

First Offense:  Principal/Student Conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Subsequent Offenses:  In-School suspension, 1-180 days Out-of-School Suspension or Expulsion

Improper Display of Affection - Consensual kissing, fondling, or embracing

First Offense:  Principal/Student Conference, In-School Suspension or 1-180 days Out-of-School Suspension

Subsequent Offenses:  Principal/Student Conference, In-school suspension or 1-180 days Out-of-School Suspension

Improper Language

Threatening Language-Use of verbal, physical or written threats to do bodily harm to person or personal property

First Offense:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Subsequent Offenses:  In-school suspension, 1-180 days Out-of-School Suspension, or Expulsion

Use of Obscene or Vulgar Language- Language which depicts sexual acts, human waste, and blasphemous language

First Offense:  Principal/Student conference, In-School Suspension, or 1-180 days Out-of-School Suspension

Subsequent Offenses:  In-school suspension, 1-180 days out of school suspension, or Expulsion

Disruptive or Demeaning Language or Conduct - Use of hate language to demean other persons due to the race, gender, disability, natural origin, or religious beliefs. This provision also includes conduct, verbal, written, or symbolic speech which materially and substantially disrupts class, school activities, transportation, or school functions

First Offense:  Principal/Student conference, In-School Suspension, or 1-180 days Out-of-School Suspension

Subsequent Offenses:  In-school suspension, 1-180 days out of school suspension, or Expulsion

Inappropriate Sexual Conduct (Refer to Policy and Regulation 2130 - Harassment)

Physical touching of another student in the area of the breasts, buttocks, or genitals

First Offense:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Subsequent Offenses:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Use of sexually intimidating language, objects, or pictures

First Offense:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Subsequent Offenses:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Indecent Exposure - Includes display of breasts, buttocks and genitals in a public location

First Offense:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Subsequent Offenses:  Principal/Student conference, In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Theft - Nonconsensual taking or attempt to take the property of another

First Offense:  Principal/Student conference, In-School Suspension, or 1-180 days Out-of-School Suspension

Subsequent Offenses:  In-School Suspension, 1-180 days Out-of-School Suspension, or Expulsion

Tobacco - Possession or use of tobacco or tobacco products

First Offense:  Principal/Student conference, In-School Suspension or 1-3 days Out-of-School Suspension

Subsequent Offenses:  In-School Suspension or 1-10 days Out-of-School Suspension

Truancy - Absent or tardy from class or classes without authorization (See also Policy and Regulation 2340 - Truancy and Educational Neglect.)

First Offense: Principal/Student conference or In-School Suspension

Subsequent Offenses:  In-School Suspension

Vandalism - Intentional damage or attempt to damage property belonging to the staff, students, or the District

First Offense: In-school suspension, 1-180 days Out-of-School Suspension, or Expulsion.  Restitution if appropriate.

Subsequent Offenses:  1-180 days Out-of-School Suspension or Expulsion.  Restitution if appropriate.

Violation of Technology Acceptable Use Agreement

First Offense: Principal/Student conference, restitution for damage, loss of computer/Internet privileges, confiscation of electronic device until the end of the day, In-School Suspension, or 1-180 days Out-of-School Suspension

Subsequent Offense: Principal/Student conference, restitution for damage, loss of computer/Internet privilege for the remainder of the school year, confiscation of electronic device until the end of the day, parent pick up of device, In-School Suspension, or  1-180 days Out-of-School Suspension
