
The discipline code set out in this regulation is intended to be illustrative but not an exclusive listing of acts of misconduct and the consequences for each. Misconduct which is not specifically listed in this regulation may be deemed to warrant discipline up to and including expulsion following provision of all due process procedures. In addition, the disciplinary consequence listed for each offense may be increased or decreased by the Administration or the Board of Education due to mitigating or aggravating circumstances.
Copies of this regulation or the student handbook which includes the code of student conduct and disciplinary consequences, as well as the District's corporal punishment policy, if any, will be provided to each student at the beginning of each school year. Copies of these documents will also be available for public inspection during normal business hours in the Superintendent's office.
Alcohol: Possession of or presence under the influence of alcohol on school premises, on the school playground, on the school parking lot, on a school bus, or at a school activity on or off of school property.
1st offense – five (5) to one hundred eighty (180) days OSS, contact parent/guardian, notification of Law Enforcement
Subsequent offenses – recommendation to Board of Education for expulsion, contact parent/guardian, notification of Law Enforcement
Arson: Intentionally causing or attempting to cause a fire or explosion.
1st offense – ten (10)) to one hundred eighty (180) days suspension, possible recommendation to Board of Education for expulsion, restitution or payment for all damages, notification of Law Enforcement
Subsequent offenses – recommendation to Board of Education for expulsion, notification of Law Enforcement
Assault: Use of physical force with the intent to do bodily harm (Refer to Policy and Regulation 2673 - Reporting of Violent Behavior)
1st offense – three (3) to one hundred eighty (180) days OSS, possible recommendation to Board of Education for expulsion, notification of Law Enforcement
Subsequent offenses – eleven (11) to one hundred eighty (180) days OSS, possible recommendation to Board of Education for expulsion, notification of Law Enforcement
Bullying (Cyberbullying): A pattern of intentional intimidation or infliction of physical, emotional, or mental harm (Refer to Policy 2655).
1st offense – ten (10) to thirty (30) days OSS
Subsequent offenses – one hundred and eighty (180) days OSS, possible Recommendation to Board of Education for expulsion
Fighting: Mutual combat in which both parties have contributed to the conflict either verbally or by physical action.
1st offense – one (1) to one hundred eighty (180) days OSS, possible recommendation to Board of Education for expulsion, notification of Law Enforcement
Subsequent offenses – three (3) to one hundred eighty (180) days OSS, possible recommendation to Board of Education for expulsion, notification of Law Enforcement
Defiance of Authority: Refusal to obey directions or defiance of school personnel authority.
1st offense – one (1) Sat Det to one (1) day OSS
Subsequent offenses – two (2) to five (5) days OSS and parent must bring student back to school the day they are to return to meet with the Principal
Disruptive Language or Conduct: Use of verbal, physical, or written expression that is generally disruptive and/or inappropriate for an educational setting. Behavior that inhibits, disrupts, or disrespects the educational environment.
1st offense – one (1) ASD to two (2) ASD
Subsequent offenses – two (2) ASD’s to ten (10) days OSS
Drugs/Controlled Substance: Possession or presence under the influence of a controlled substance or substance represented to be a controlled substance while on school premises, on the school playground, on the school parking lot, on a school bus, or at a school activity whether on or off of school property.
1st offense – five (5) to one hundred eighty (180) days OSS, contact parent/guardian, notification of Law Enforcement

Drugs/Controlled Substance: Sale or distribution of a controlled substance or substance represented to be a controlled substance while on school premises, on the school playground, on the school parking lot, on a school bus, or at a school activity whether on or off of school property.

Prescription Medication: Possession of a prescription medication without a valid prescription for such medication on school premises, on the school playground, on the school parking lot, on a school bus, or at a school activity on or off of school property.
1st offense – five (5) to one hundred eighty (180) days OSS, contact parent/guardian, notification of Law Enforcement
Subsequent offenses – recommendation to Board of Education for expulsion, contact parent/guardian, notification of Law Enforcement
Prescription Medication: Sale or distribution of prescription medication to any individual who does not have a valid prescription for such medication on school premises, on the school playground, on the school parking lot, on a school bus, or at a school activity on or off of school property.
All offenses – 10-180 days OSS, possible recommendation to Board of Education for expulsion, contact parent/guardian, notification of Law Enforcement
Extortion: Use of verbal, physical, or written threats, expression, or conduct designed to obtain money or other valuables
1st offense – one (1) to ten (10) days OSS, restitution of valuables, contact parent/guardian, possible notification of Law Enforcement
Subsequent offenses – one (1) to one hundred and eighty (180) days OSS, restitution of valuables, possible notification of Law Enforcement, possible recommendation to Board of Education for expulsion
Possession of a firearm or weapon: All weapon incidents will be reported immediately to Law Enforcement agencies (Refer to Policy and Regulation 2620 - Firearms and Weapons in School).
All offenses – minimum of a one calendar year suspension. This suspension provision may be modified on a case-by-case basis upon recommendation of the District Superintendent if the Superintendent determines that circumstances justify such a modification.
Harassment: (Refer to Policy 1300 and or Regulation 1300 - Harassment)
1st offense – one (1) Sat Det or 1-180 days OSS, notification of law enforcement
Subsequent offenses – one (1) to ten (180) days of OSS, notification of law enforcement
Improper Display of Affection: Consensual kissing, fondling, or embracing
1st offense – Principal/student conference
Subsequent offenses – one (1) ASD to ten (10) days of OSS, contact parent/guardian
Threatening Language or Conduct: Use of verbal, physical, or written threats to do harm to a person or personal property.
All offenses – one (1) Sat Det to one hundred eighty (180) days OSS and parent must bring student back to school the day they are to return, to meet with Principal, possible recommendation to Board of Education for expulsion
Obscene/Vulgar Language or Conduct: Use of verbal, physical, or written expression including but not limited to those depicting sexual acts, human or nonhuman waste, blasphemous language, and expressions or gestures otherwise rude, vulgar, or considered inappropriate for an educational setting.
1st offense – one (1) ASD to two (2) days OSS
Subsequent offenses – two (2) to ten (10) days OSS
Generally Disruptive Language or Conduct: Use of verbal, physical, or written expression that is generally disruptive and/or inappropriate for an educational setting. Behavior that inhibits, disrupts, or disrespects the educational environment.
1st offense – one (1) ASD to two (2) days OSS
Subsequent offenses – two (2) to ten (10) days OSS
Inappropriate Touching: Physical touching of another student in the area of the breasts, buttocks, or genitals.
1st offense – two (2) ASD to two (2) days OSS, contact parent/guardian
Subsequent offenses – two (2) to five (5) days OSS and parent must bring student back to school the day they are to return to meet with the Principal
Use of sexual language: Use of sexually intimidating language, objects, or pictures.
1st offense – two (2) ASD to two (2) days OSS, contact parent/guardian
Subsequent offenses – two (2) to five (5) days OSS and parent must bring student back to school the day they are to return to meet with the Principal
Indecent Exposure: Includes display of breasts, buttocks or genitals in a public location
1st offense – two (2) ASD to two (2) days OSS, contact parent/guardian
Subsequent offenses – two (2) to five (5) days OSS and parent must bring student back to school the day they are to return, to meet with the Principal
Theft: Nonconsensual taking, or the attempt to take, the valuables, property, or possessions of another; knowingly possessing stolen valuables, property, or possessions of another.
1st offense – one (1) to one hundred eighty (180) days OSS, restitution or payment, contact parent/guardian, possible notification of Law Enforcement
Subsequent offenses – eleven (11) to one hundred eighty (180) days OSS, possible recommendation to Board of Education for expulsion, contact parent/guardian, restitution or payment, notification of Law Enforcement
Tobacco: The possession or use of Tobacco or Tobacco-like products is prohibited. This prohibition includes electronic cigarettes, vaping and similar objects used in conjunction with vaping. Therefore, the Board prohibits the use, sale, transfer and possession of tobacco products and substances appearing to be tobacco products, i.e., e-cigarettes, vaping paraphernalia, at school and at school activities.
1st offense – three (3) days OSS, contact parent/guardian, notification of Law Enforcement if student is under the age of 18
Subsequent offenses – five (5) to ten (10) days OSS, contact parent/guardian, notification of Law Enforcement if student is under the age of 18
Truancy: A student who stays away from an assigned area or leaves school without permission. Students must sign out in the office before leaving school for any reason. Students who do not sign out will be considered truant. If parents cannot be reached on the first offense and students are not located within a reasonable time, law enforcement will be called to report that the student is missing. (See also Policy and Regulation 2340-Truancy and Educational Neglect.)

Vandalism: Intentional damaging or destroying or attempt to damage or destroy property belonging to the staff, students, or the school district.
1st offense – one (1) to one hundred eighty (180) days OSS, restitution for all damages, possible recommendation to Board of Education for expulsion, possible notification of Law Enforcement
Subsequent offenses – eleven (11) to one hundred eighty (180) days OSS, restitution for all damages, possible recommendation to Board of Education for expulsion, possible notification of Law Enforcement
