P 4710.1 Resignation: Certificated Staff

The Board of Education considers serious illness, transfer of spouse, and military service as legitimate reasons for resignation of professional staff and may elect to waive any or all monetary penalty. However, the Board will consider each resignation on an individual basis. In most cases, resignations become effective at the end of the school year in which they are submitted.

Tenured teachers must submit a written notice of resignation to the superintendent prior to June 1 in order to avoid payment of liquidated damages and the suitable replacement clause. Probationary teachers must submit a letter of resignation to the superintendent prior to May 1, to avoid a financial penalty, if the Board and the teacher have executed a contract for the following school year. It will be at the discretion of the Board, based on recommendation from the superintendent, if the probationary teacher shall be released.

Beginning June 1 for tenured teachers and May 1 for probationary teachers, and continuing thereafter until said contractual agreement is completed, a professional staff member who wishes to be released from the signed contract shall:

  1. Submit a request in writing to the superintendent,
  2. Pay an amount of liquidated damages as outlined below, and
  3. Be released only when it has been determined that a suitable replacement is available, and that the tenets of the Missouri Teacher Tenure Act are being followed.

The liquidated damages assessed for release from contract shall be $500 on June 1 for tenured teachers and $500 on May 1 for probationary teachers. An additional $20 per calendar day after June 1 until June 30 for tenured teachers and May 1 until May 31 for probationary teachers will be assessed. Any request for release from a contract on or after July 1 for tenured teachers and June 1 for probationary teachers will be subject to an additional penalty payment of $1500.

Letters of resignation will be submitted to the superintendent of schools. The resignation will be acted upon by the Board at the first board meeting after submission of the letter of resignation.
