R 4710 Resignation: Certificated Staff

Certificated employees who wish t resign should address a letter of resignation to the' Superintendent/designee and the principal/supervisor. The letter should state reasons and an effective date for the resignation.

Release from Contract

Any contract may be terminated at any time by mutual consent. Any request for release from contract by a professional staff member other than the superintendent shall be submitted in writing and directed to the superintendent. A teacher will not be released from contract unless a suitable replacement is available, and then only on conditions set forth in the Missouri Teacher Tenure Act. The Board may consider a release of contract for the following reasons:

  1. Health --- Any request for a release of contract based upon the health of the professional staff member shall require a certificate by a physician that continued employment will be detrimental to the person's health.
  2. Transfer of Spouse --- If a teacher's spouse receives a transfer from the geographical area, the Board may grant a release, but the release shall be conditional upon the employment of a duly qualified replacement.
  3. Other Reasons --- Recognizing that the teacher's contract is a legal document which binds both the teacher and the Board, the Board's attitude shall generally be one of disapproval for requests of release of contract for reasons other than health or transfer of spouse. The Board will at all times hold the welfare of the students paramount during the consideration and deliberation of requests for release.

There are however, times when a teacher will receive an offer of employment elsewhere and will ask to be released from the obligations of the contract. A request for release from a contract for reasons other than health, or transfer of spouse, must be accompanied by a check as specified below, and said request may or may not be granted after consideration by the Board. The Board will at all times hold the welfare of the students paramount during the consideration and deliberation of requests for release. Any such release shall be conditional upon employment of a duly qualified replacement.

If a majority of the Board votes favorably for the requested release, the sum deposited shall be paid as liquidated damages and become the property of the school district. If the Board votes against the requested release, the teacher shall fulfill the obligation of the signed contract and the sum deposited shall be returned to the teacher. Terms for payment of the required amount can only be changed by a vote of the Board.

Release requested date contract signed through May 31 (Probationary) --- $200
Release requested June 1 through June 30 --- $400
Release requested July 1 through July 31 --- $600
Release requested August 1 through August 31 --- $800
Release requested September 1 and after --- $1,000

Release of Contract, Administrators (Superintendent, Principals)

The conditions listed under "Release of Contract, Teachers" shall apply to administrators employed by the district; however, the deadline dates and financial amounts shall be as follows:

Released requested between 1St and 30th day after signing by administration --- $250
Released requested between 31St and 60th day after signing by administration --- $500
Released requested between 61St and 90th day after signing by administration --- $750
Released requested between 91St and 120th day after signing by administration --- $1,000
Released requested 121St day an after signing by administration --- $2,000
