R 2610 Misconduct and Disciplinary Consequences

The discipline code set out in this regulation is intended to be illustrative but not an exclusive listing of acts of misconduct and the consequences for each. Misconduct which is not specifically listed in this regulation may be deemed to warrant discipline up to and including expulsion following provision of all due process procedures. In addition, the disciplinary consequence listed for each offense may be increased or decreased by the Administration or the Board of Education due to mitigating or aggravating circumstances.

Copies of this regulation or the student handbook which includes the code of student conduct and disciplinary consequences, as well as the District's corporal punishment policy, if any, will be provided to each student at the beginning of each school year. Copies of these documents will also be available for public inspection during normal business hours in the Superintendent's office.

Alcohol - Possession of or presence under the influence of alcohol regardless of whether the student is on school premises

First Offense: Ten days out-of-school suspension (Law/Authorities contacted).

Subsequent Offenses: A recommendation to the superintendent for an eleven to a hundred-eighty day out-of-school suspension (Law/Authorities contacted). Expulsion.

Arson - Intentionally causing or attempting to cause a fire or explosion

First Offense: Five to ten days out-of-school suspension to expulsion (Authorities contacted).

Subsequent Offenses: Ten days out-of-school suspension to expulsion (Authorities contacted).

Assault - (Refer to Policy and Regulation 2673- Reporting of Violent Behavior)

Assault of a Student or Staff Member - Use of physical force with the intent to do bodily harm.

First Offense: Three days in-school suspension, parents notified, authorities and violence hotline contacted (at discretion of principal or principal's designee.)

Subsequent Offenses:Three days out-of-school suspension, parents contacted, authorities and violence hotline contacted. (Law/Authorities contacted).;Ten days out-of-school suspension.

Bullying - Intentional intimidation or infliction of physical, emotional, or mental harm (see Policy 2655).

First Offense: Three days in school suspension, Parents and appropriate authorities contacted.

Subsequent Offenses:1-10 days out of school suspension, parent and appropriate authorities contacted.; Recommendation to Superintendent for 180 day suspension. *Any offense could result in removal from any or all-extracurricular participation.

Fighting - Physically striking another in a mutual contact as differentiated from an assault.

First Offense: One to three days in-school suspension; one to ten days out-of-school suspension, parents notified, juvenile office notified.

Subsequent Offenses: One to ten days out-of-school., parents notified, juvenile office notified.

Defiance of Authority - Refusal to obey directions or defiance of staff authority

First Offense: Parental conference, one-day in-school suspension.

Subsequent Offenses: Two days in-school suspension-Parents (guardian) are informed the day of the violation by (1) letter (one copy given to the student), (2) telephone when possible (Law/Authorities contacted).; One to ten days out-of-school suspension (Authorities contacted, violence hotline contacted).

Disruptive Behavior - Conduct which has the intentional effect of disturbing education or the safe transportation of a student

First Offense: One to three days detention; One-day in-school suspension.

Subsequent Offenses: One to three days in-school suspension.

Drugs/Controlled Substance

Possession or presence under the influence of a controlled substance or substance represented to be a controlled substance while at school, on the school playground, on the school parking lot, a school bus or at a school activity whether on or off of school property.

First Offense: Ten days out-of-school suspension (Law/Authorities contacted).

Subsequent Offenses: A recommendation to the superintendent for an eleven to a hundred-eighty day out-of-school suspension. (Law/Authorities contacted); Expulsion.

Sale of a controlled substance or substance represented to be a controlled substance while at school or at any of the locations described above.

First Offense: Eleven to a hundred-eighty day out-of-school suspension (Law/Authorities contacted).

Subsequent Offenses: Expulsion

Prescription Medication

Possession of a prescription medication without a valid prescription for such medication on school premises or on a school bus.

First Offense: Ten days out-of-school suspension (Law/Authorities contacted)

Subsequent Offenses: A recommendation to the superintendent for an eleven to a hundred-eighty day out-of-school suspension. (Law/Authorities contacted); Expulsion.

Distribution of prescription medication to any individual who does not have a valid prescription for such medication on school premises or on a school bus.

First Offense: Eleven to a hundred-eighty day out-of-school suspension (Law/Authorities contacted).

Subsequent Offenses: Expulsion

Extortion - Verbal threats or physical conduct designed to obtain money or other valuables

First Offense: Three days in-school suspension, parents, authorities and violence hotline contacted.

Subsequent Offenses: Three days in-school suspension, parents, authorities and violence hotline contacted.

Firearms and Weapons (Refer to Policy and Regulation 2620 - Firearms and Weapons in School)

Possession of a firearm or weapon

First Offense: Parent conference, one-year suspension from school. Law authorities contacted immediately.

Subsequent Offenses: Expulsion

Harassment

First Offense: One-day in-school suspension.

Subsequent Offenses: Three days in-school suspension.; One to ten days out-of-school suspension.

Improper Display of Affection - Consensual kissing, fondling, or embracing

First Offense: One to three days detention.

Subsequent Offenses: One to three days in-school suspension.

Improper Language

Threatening Language - Use of verbal, physical or written threats to do bodily harm to person or personal property.

First Offense: One to three days in-school suspension.

Subsequent Offenses: One to ten days out-of-school suspension.

Use of Obscene or Vulgar Language - Language which depicts sexual acts, human waste, and blasphemous language

First Offense: One to three days detention.

Subsequent Offenses: One to five days in-school suspension; One to ten days out-of-school suspension.

Disruptive or Demeaning Language or Conduct - Use of hate language to demean other persons due to the race, gender, disability, natural origin, or religious beliefs. This provision also includes conduct, verbal, written, or symbolic speech which materially and substantially disrupts class, school activities, transportation, or school functions.

First Offense: One-day in-school suspension.

Subsequent Offenses: One to three days in-school suspension.

Inappropriate Sexual Conduct

Physical touching of another student in the area of the breasts, buttocks, or genitals

First Offense: Three days in-school suspension and parents notified.

Subsequent Offenses: Two days out-of-school suspension, sessions with counselor, juvenile officer contacted.

Use of sexually intimidating language, objects, or pictures.

First Offense: One to three days in-school suspension and parents notified.

Subsequent Offenses: Three to ten days out-of-school suspension and parents notified (Law/Authorities contacted).

Indecent Exposure - Includes display of breasts, buttocks and genitals in a public
location

First Offense: Minimum three days in-school suspension, parents contacted, mandatory counseling sessions with the school counselor, no activities without direct parental supervision for at least the length of one quarter effective immediately. Legal authorities and violence hotline contacted at the discretion of principal or principal's designee.

Subsequent Offenses: Three days out-of-school suspension, parents contacted, no activities without direct parental supervision for at least the length of two quarters effective immediately, legal authorities and violence hotline contacted.; Ten days out-of-school suspension.

Theft - Nonconsensual taking or attempt to take the property of another

First Offense: Restitution, cost of material, labor, and notify authorities. One-day in-school suspension and detention.

Subsequent Offenses: Restitution, cost of material, labor, and notify authorities. Three days in school suspension.; Restitution, cost of material, labor, and notify authorities. One to ten days out of-school suspension.

Tobacco - Possession or use of tobacco or tobacco products

First Offense: Three-days in-school suspension – Parents (guardian) are informed the day of violation by (1) letter (one copy given to the student), (2) telephone, when possible.

Subsequent Offenses: Three to ten days out-of-school suspension – Parents (guardian) are informed the day of the violation by (1) letter (one copy given to student), (2) telephone, when possible.

Truancy - Absent or tardy from class or classes without authorization (See also Policy and Regulation 2340 - Truancy and Educational Neglect.)

First Offense: One to three days detention, parents and authorities notified.

Subsequent Offenses: Two to five days detention and parents and authorities notified.

Vandalism - Intentional damage or attempt to damage property belonging to the
staff, students, or the District

First Offense: Restitution, cost of material, labor, notify authorities. One to three days in school suspension.

Subsequent Offenses: Restitution, cost of material, labor, notify authorities. Three to ten days out-of-school suspension.
